Important: These Terms and Conditions of Sale (“Terms”) govern all package travel contracts concluded between Lord of Swiss SA, trading as Kairos Travel, and any customer (“the Traveller”). They are drafted in accordance with the Swiss Federal Act on Package Travel (LVF, SR 944.3) and Directive (EU) 2015/2302 on package travel. Any booking constitutes full and unreserved acceptance of these Terms.

Article 1 — Organiser

Article 2 — Definitions

“Package travel”: combination of at least two different types of travel services for the same trip. “Traveller”: any person seeking to conclude a contract. “Organiser”: Lord of Swiss SA. “Local partner”: Travco Travel Company of Egypt (Cairo).

Article 3 — Pre-contractual information

Before the contract, the Traveller receives standardised information per Annex I of Directive (EU) 2015/2302: main characteristics, total price TTC, payment terms, minimum participants, passport/visa, health info, organiser identity, financial guarantee, professional liability, right to transfer, right to terminate.

Article 4 — Contract formation

Booking is offline (form, email or direct contact). The contract forms when the organiser confirms in writing and the Traveller pays the deposit (Article 6).

Article 5 — Price

Price is in CHF or EUR depending on residence, all-inclusive of taxes and mandatory fees. International flights excluded unless stated. Price revisable up or down up to 20 days before departure only for transport, tax or exchange rate variations. Any increase above 8% entitles the Traveller to terminate free of charge.

Article 6 — Payment

Deposit of 30% on confirmation. Balance due 30 days before departure. For bookings under 30 days, full price on confirmation. Default in payment authorises termination with cancellation fees (Article 9).

Article 7 — Contract transfer

Per Article 17 LVF, the Traveller may transfer the contract with reasonable notice up to 7 days before departure. Transferor and transferee jointly liable for price and reasonable transfer fees.

Article 8 — Modification by the organiser

Non-essential terms modifiable with clear written notice. Essential modifications (transport, accommodation, dates, price beyond Article 5 threshold) give the Traveller the right to accept or terminate free of charge with full refund.

Article 9 — Cancellation by the Traveller

Cancellation fees on total trip price:

Certain services (flights, cruises, high-season accommodation) may be non-refundable from confirmation. Indicated in the confirmed quote.

Article 10 — Cancellation by the organiser

Full refund without compensation if (i) minimum participants not reached (notice 20 days before departure for trips over 6 days, 7 days for 2-6 day trips, 48h for under 2 days); (ii) exceptional and unavoidable circumstances. Otherwise, compensation may apply.

Article 11 — Force majeure

Natural disasters, armed conflicts, civil unrest, official health restrictions, formal Swiss FDFA travel warnings, etc. Traveller may terminate before departure with full refund, no additional compensation.

Article 12 — Organiser liability

Organiser liable for proper performance of all services, whether performed directly or by subcontractors (including DMC Travco). International convention liability ceilings apply (Montreal, Athens). Contractual liability capped at 3× total trip price, except for personal injury and wilful/gross misconduct.

Article 13 — Assistance obligation

The organiser provides timely assistance to Travellers in difficulty: health, local authorities, consular contacts, remote communications, alternative travel solutions. Reasonable charge may apply if difficulty caused intentionally or by negligence by the Traveller.

Article 14 — Complaints

Non-conformities must be reported as soon as possible on site to organiser or DMC Travco. Written complaint by email to info@kairos-travel.ch no later than 5 days after scheduled return date, failing which inadmissible per DMC contract.

Article 15 — Financial guarantee

Per Article 18 LVF, the organiser maintains a guarantee covering insolvency refunds and repatriation. Lord of Swiss SA is in the process of joining a recognised Swiss guarantee fund. References will be published upon entry into force.

Article 16 — Professional liability insurance

Subscription in progress for a professional liability policy covering personal injury, material and consequential damages. References communicated on request.

Article 17 — Traveller travel insurance

The organiser strongly recommends the Traveller subscribe additional insurance (cancellation, interruption, medical, repatriation, luggage) at their own expense.

Article 18 — Travel documents

The Traveller ensures passport validity at least 6 months after return, plus visas, health certificates and authorisations. General formalities communicated for Swiss and EU nationals.

Article 19 — Travelling minors

Minors without parental authority require written parental authorisation and any additional documents per destination country.

Article 20 — Personal data

Processed per nLPD and GDPR. See Privacy Policy. Data transmitted to DMC Travco (Egypt) under standard contractual clauses.

Article 21 — Mediation

Prior referral to Swiss Tourism Ombudsman — www.ombudsman-touristik.ch — before any legal action.

Article 22 — Governing law and jurisdiction

Swiss law. Subject to mandatory consumer protection rules, exclusive jurisdiction of the courts of the Canton of Geneva.
